Community Care/ Court of Protection Solicitor

Southampton, Hampshire

This role is based in the firms Southampton Office and can be flexible with remote working.

This well-established and award-winning firm are looking to recruit a Community Care/ Court of Protection/ Solicitor to join their highly regarded team to provide sound legal advice and be a part of this commercially focused and determined firm.

The successful candidate would ideally have experience in both Community Care and Court of Protection areas of Law.

Areas of focus will include:

Court of Protection

  • Advising the elderly, disabled and vulnerable individuals both in the everyday execution of their affairs, and in the protection from and prosecution against abuse, coercion and exploitation.
  • Managing/making decisions relating to property and financial affairs.
  • Preparing LPA’s.
  • Drafting applications to the Court of Protection.
  • Preparation of annual reports and billing and file management.

Healthcare/ NHS funded Care

  • Advising on eligibility for NHS continuing healthcare funding.
  • Challenging the withdrawal and any changes to NHS CHC.

Financial Assessments & Charging

  • Advising on care and funding including supported living, shared lives schemes or residential care.
  • Managing issues regarding personal budgets and payments.

Care Act Assessments

  • Advising on how needs can be met regarding the levels of support or ways needed.
  • Advising on social care needs of adults under the Care Act 201 at home or in care.
  • Reviewing refusals from local authorities to assess individuals care or support.

Personal Characteristics:

  • Strong organisational and time management skills are required as the role will involve the efficient and cost effective management of multiple files, often working to strict deadlines;
  • Excellent interpersonal skills are essential to demonstrate understanding of our clients’ needs and expectations;
  • Good communications skills are also crucial as the successful candidate will have regular client contact and will often be required to explain complex areas of law in a simple and coherent way.
  • Focussed attention to detail, speed and accuracy are important for all written documentation;
  • The candidate should be a team player and contribute to the continued success of the team
  • At least 3 years PQE or relevant pre-qualification experience
  • Court of Protection knowledge experience essential
  • Law Society Accreditation or eligibility to join a scheme desirable
  • Track record of developing a caseload and client care skills
  • Positive ‘can do’ attitude
  • Familiarity with Case Management systems, in particular LEAP.
