About the Role

You will report to the Group General Counsel, Richard Given . Together with the regulatory lawyer, you will make up that part of the legal team that’s in the UK. Using Zoom, Teams, Slack etc. you will work closely alongside the rest of the legal team in Bulgaria (you would not normally be expected to travel to Bulgaria more than once in a year). You will provide general corporate and commercial legal support across the business, supporting the Group’s requirements here in the UK as well as Malta and across the EU. You will work closely with teams across the business, including Sales, Compliance, Risk, Finance, Information Security, and the Technology Team.

It is important for OpenPayd that you always remember that you are first and foremost a solicitor or barrister . We recognise the inherent conflict between the requirements for independence and the fact that your “client” is your employer. OpenPayd needs its lawyers to ensure that the legal advice and support provided is mindful of those professional obligations.

You will be initially focused on drafting and negotiating commercial contracts with customers and suppliers, both in the UK and overseas and overseeing adherence to the contractual obligations in those agreements. This will involve supporting and working closely with our Senior Legal Counsel in Bulgaria who has overall responsibility for our customer engagements. In time, we would also look for you to support the Group General Counsel in the delivery of the group’s strategy as and when the need arises.

Examples Of What Else This Might Involve

· Understanding of flow of funds for Customers (and their end-users) and how these relate to our Banking partners and compliance requirements

· Analysing the regulatory regime applicable to the proposed use case for Customers and confirming the requirements for accepting the proposed business flows

· Supporting the Data Privacy Officer and the Finance teams on managing the intra-group arrangements to comply with relevant legal and regulatory requirements in each jurisdiction.

· Supporting the development and maintenance of appropriate templates and processes across the group to facilitate self-service and to empower colleagues within the Group’s risk appetite

· Reviewing group policies and processes in support of the Risk Function

· Supporting the customer success team on monitoring contract compliance and putting in place any amendments or variations required as engagements evolve

· Providing training as required to colleagues on the use of templates, adherence to policies etc.

Requirements

Normally, at this stage in a job description, there is some identikit statement about the need for a 2:1 from a Russell Group University (or similar) and experience at some “topflight” law firm. There is also often included an expectation of “at least [x] years post qualification experience in financial services or fintech”.

There is a reason that this is not included here. Whether that is you or not, we would love to hear from you. We are looking for someone who is well-rounded, can work independently and is not afraid to “roll their sleeves up and get stuck in”. It is about being creative in solving issues where the focus is not on “winning at any cost” rather finding ways for OpenPayd to be successful that also support the customers’ goals.

Excellent command of the English language is a requirement. Previous experience in either an online payments or financial services environment (e-wallets, banking, online-processing) would, of course, be ideal. However, any experience of working in a regulated environment would also be a positive.

You may not be a member of the Law Society or the Bar Council in the United Kingdom. You may have undertaken your training in-house or just not in a ‘traditional’ law firm. You may have taken a career break for several years. Your journey may just not be considered ‘standard’. We believe these are things that can enrich a candidate and do not disqualify them.

OpenPayd operates a hybrid approach to working. As the needs of the business evolve, the approach will flex accordingly. Currently, we are expected to be in the office, on average, three days a week and to attend face to face meetings where it makes sense to be “in the room”. Otherwise, we are just expected to have an appropriate working environment with stable broadband.

It will surprise no-one that OpenPayd is committed to paying a competitive salary for this role. We have purposively decided not to state a salary range. It will depend on the level of experience and expertise the successful candidate brings to the role. We do not want to dissuade anyone from applying because the salary we might put here is at the wrong level.
